Terms of Service

These Terms of Service ("Terms") govern your access to and use of FTW Notify, including our mobile application (iOS and Android), website at ftwnotify.com, and all related services (collectively, the "Service"), operated by FTW Agency ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

FTW Notify is a notification service that connects to your Stripe accounts via Stripe OAuth (Connect) and delivers real-time push notifications to your mobile device for events including, but not limited to: successful payments, failed payments, new subscriptions, subscription cancellations, refunds, chargebacks (disputes), and payouts.

We only read your Stripe data — we never initiate transactions, transfer funds, issue refunds, or modify any data within your Stripe accounts.

2. Eligibility

• You must be at least 18 years old to use the Service.
• You must have a valid Stripe account to connect to the Service.
• You must have the authority to connect any Stripe account you link to the Service.
• You are responsible for ensuring your use of the Service complies with all applicable laws and regulations in your jurisdiction.

3. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@ftwnotify.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription & Pricing

4.1 Plans

FTW Notify is offered as a paid subscription service with the following plans:

• Annual plan — $99 per year, billed annually.
• Monthly plan — $14.99 per month, billed monthly.

All plans include unlimited Stripe account connections, all supported alert types, quiet hours, sound customization, deep links to Stripe Dashboard, account labels, and priority support.

4.2 Billing

• All payments are processed securely by Stripe.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• Prices are listed in US Dollars (USD). Applicable taxes may be added at checkout.
• You authorize us to charge the payment method on file for recurring subscription fees.

4.3 Cancellation

• You may cancel your subscription at any time.
• Upon cancellation, your subscription remains active until the end of the current billing period.
• No prorated refunds are issued for partial billing periods.
• After your subscription expires, you will lose access to the Service's features and your connected Stripe accounts will be automatically disconnected.

4.4 Refunds

Since FTW Notify provides immediate access to the Service upon purchase, refunds are generally not provided. However, we may consider refund requests on a case-by-case basis within 14 days of purchase. Contact support@ftwnotify.com for refund inquiries.

4.5 Price Changes

We reserve the right to change our pricing at any time. If we change the price of your plan, we will notify you at least 30 days before the change takes effect. Your continued use of the Service after the price change constitutes acceptance of the new pricing.

5. Stripe Account Connections

• By connecting a Stripe account, you authorize FTW Notify to access event data from that account via Stripe OAuth. We use this access exclusively to receive event notifications.
• You represent and warrant that you have the authority to connect each Stripe account to the Service.
• You may disconnect any Stripe account at any time from within the app. Disconnection immediately revokes our access to that account.
• We are not responsible for any actions taken by Stripe or changes to the Stripe API that may affect the Service's functionality.
• You acknowledge that notification delivery depends on Stripe sending webhook events to our servers in a timely manner, which is outside our control.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Connect Stripe accounts that you do not own or are not authorized to access.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Use automated systems (bots, scrapers) to access the Service, except as expressly permitted.
• Resell, redistribute, or sublicense the Service without our written consent.
• Use the Service to monitor Stripe accounts for the purpose of competitive intelligence against the account owners.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, sounds, software, and design — are the exclusive property of FTW Agency and are protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms.

8. Push Notifications

• The core functionality of FTW Notify depends on push notifications. You must enable push notifications on your device for the Service to function as intended.
• We use Expo Push Notification Service, Apple Push Notification Service (APNs), and Firebase Cloud Messaging (FCM) to deliver notifications.
• We cannot guarantee delivery of every notification. Notification delivery depends on your device settings, network connectivity, and third-party push notification services.
• FTW Notify should not be used as your sole monitoring solution for critical or time-sensitive business operations.

9. Service Availability & Modifications

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
• We may add, change, or remove features at our discretion. We will make reasonable efforts to notify you of material changes.

You agree to indemnify, defend, and hold harmless FTW Agency, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any third-party rights, including Stripe's terms of service.
• Your connection of Stripe accounts you are not authorized to access.

13. Termination

• You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.
• We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in behavior that may harm the Service or other users.
• Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
• Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will survive.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

15. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you via email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FTW Agency regarding your use of the Service, and supersede all prior agreements and understandings.
